TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern all services provided by Soflo Beach Retreats LLC (“Provider”) to the client (“Client”). By booking or using our services, Client agrees to the following:

1. Scope of Services

Provider agrees to perform cleaning services as outlined in the estimate, proposal, invoice, or booking confirmation.

All quotes are based on information provided by Client. If the actual condition, size, or scope of the property differs materially from what was represented, Provider reserves the right to adjust pricing accordingly.

Additional services requested at the time of service may result in additional charges.

2. Post-Construction Services Disclaimer

Post-construction cleaning involves dust, debris, and materials that may be unpredictable. While Provider will make every effort to thoroughly clean the property, the following apply:

  • Some residual dust or fine debris may remain despite professional cleaning.

  • Additional time and charges may apply if the property requires extensive or specialized cleaning beyond the scope of the estimate.

  • Provider is not responsible for pre-existing damage or fragile fixtures affected by construction work.

  • Client must disclose any fragile or valuable items prior to service.

3. Access & Utilities

Client must provide safe and timely access to the property at the scheduled service time.

Water and electricity must be fully operational.

If Provider is unable to access the property, or utilities are not functioning, a lockout fee up to 50% of the scheduled service may apply.

4. Payment Terms

Payment terms are as follows unless otherwise agreed in writing:

  • Residential & short-term rental services: Payment due on the day of service.

  • Commercial or recurring services: Payment due within 7 days of invoice date.

  • Accepted payment methods include: Cash, Check, Zelle, ACH bank transfer, and credit card payments (for an added processing fee).

  • Large projects or post-construction services: 50% Deposit may be required prior to service.

Provider reserves the right to require payment in advance.

Late Payments

Invoices not paid within the agreed timeframe will incur:

  • A late fee of 5% of the outstanding balance after 3 days past due.

  • Interest at 1.5% per month (18% annually) on unpaid balances.

  • Suspension of future services until account is brought current.

Accounts over 30 days past due may be referred to collections. Client agrees to pay all reasonable collection costs, including attorney’s fees and court costs.

5. Cancellations & Rescheduling

Cancellations must be made at least 24 hours prior to scheduled service.

  • Cancellations made less than 24 hours before service may be charged 30% of the scheduled service fee.

  • Same-day cancellations or failure to provide access may be charged up to 50% of the service fee.

  • Repeated last-minute cancellations may result in termination of recurring services.

6. Satisfaction Policy

Client must report any service concerns within 24 hours of completion. Provider will return to address specific areas of concern at no additional charge.

Refunds are not guaranteed and are issued at Provider’s sole discretion.

7. Damages & Liability

Client must notify Provider of any damage claims within 24 hours of service completion.

Provider is not responsible for:

  • Pre-existing damage

  • Improperly secured items

  • Normal wear and tear

  • Damage due to faulty fixtures, loose tiles, weak surfaces, or improperly installed items

  • Items not disclosed as fragile or valuable

Provider’s total liability for any claim shall not exceed the total amount paid for the service giving rise to the claim.

Provider shall not be liable for indirect, incidental, or consequential damages.

8. Health & Safety

Provider reserves the right to refuse or discontinue service if:

  • The environment is unsafe

  • Hazardous materials are present

  • Aggressive pets are not secured

  • Biohazards or excessive debris are present beyond disclosed scope

Additional fees may apply for heavy soil, hoarding conditions, or hazardous cleanup.

9. Termination

Either party may terminate recurring service agreements with 7 days’ written notice.

Any unpaid balances for completed services remain due and payable.

10. Privacy

Provider respects Client privacy and will not disclose personal information except as required by law.

11. Governing Law & Venue

This Agreement shall be governed by and interpreted under the laws of the State of Florida.

Any disputes arising under this Agreement shall be resolved in the courts located in Palm Beach County, Florida.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements or understandings, whether written or oral.
